Mediation and Alternative Dispute Resolution Services

Joan Protess & Associates ("JP&A") specializes in providing dispute resolution services, including mediation, in futures, securities, employment and other commercial matters. JP&A provides these services on a nationwide basis.

For over 30 years, JP&A has served as the outside administrator of the National Futures Association’s ("NFA’s") fully subsidized mediation program. During that time, JP&A has settled thousands of NFA arbitration matters. JP&A also has resolved many Commodity Futures Trading Commission reparations cases and futures exchange arbitration matters.

Since 1995, JP&A also has mediated successfully hundreds of securities disputes filed at the National Association of Securities Dealers, Inc., and the New York Stock Exchange, now known as the Financial Industry Regulatory Authority, or FINRA. These cases involve a wide variety of legal issues and investment vehicles. The damage claims in such cases range from $1,000.00 to over $50 million.

As part of its dispute resolution practice, JP&A also has mediated successfully numerous employment disputes, which have involved claims of breach of contract, age, gender and racial discrimination, wrongful termination, defamation, and other workplace issues. JP&A also has mediated effectively contract, shareholder, partnership, corporate and other commercial cases filed with the American Arbitration Association, and in various federal and state courts.

In addition to being a recognized provider in the mediation field, JP&A also offers other alternative dispute resolution ("ADR") services, including dispute avoidance, negotiation, development of ADR programs, and training in ADR methods.
